Vulnerability of ILL Appointments

Although, I have tried my level best, to gather and correlate my knowledge with the contest , in lieu to enable me start, discussion on the subject topic but ,I feel my incapacity to pin out the thread to start with .
Declaring your own living as vulnerable and fatal indicates your own possessions, a failure.
The said remarks, does not only qualify, to be tagged for place, but it also signifies individual’s attitude and abilities to respond, to reactions and of course his actions, move, interactions and reactions.
Recalling the memory to start with, I was born in a family of professional but influential semi political backbenchers playing their role according to the need and requirement of the real players.
To summarize as explanation to the contest, and to cut short the sentence precisely into a terminology, the real godfathers.
Although, the word itself has familiarity among people in various horizons of life, but it has universally been and infact, extensively been used in set ups of mafia, as the man behind.
It is worth mentioning here, that, from the day I started to realize things around, I had minimum opportunity to interact on issues with my fathers, on ongoing political and regional public issues, during the era, however I do had some, breaks to go through discussions on the topics being in pursuance, and progress at the honorable courts of Pakistan.
Weather it’s a merciless death of Zulfikar ali Bhutto ,or white paper against Gen. Zia , be the ,appointment of president Rafiq Tarar , or veena hayat case ,appointment of zardari as senator ,murder of Mir Murtaza Bhutto ,engagement of Mohtarma Benazir Bhutto by Saifur Rehman ,dissolution of assemblies to military trials of civilians, appointment of judges to selection of attorney general and any other issues as probono publico, I realizes now that it was an assets that I had the opportunity to receive first hand information on the issues and to see that how man behind, plays and react to safe and secure these front seats by virtue of their expertise and professionalism in field and of course in politics.
By collectively converging my back up knowledge and events that I came across during my life by virtue of close interaction on many fold hot issues of the country ,and of course close interactions of so many political figures of Pakistan with my father ,and their day to day grievances and remedies to console them ,I have developed an essence to scrutinize the subject whatsoever ,by evaluating and figuring out on the basis of factual circumstantial evidences on the core of subject .
Pakistani politics, in my opinion has no essence, by virtue of which a politician expresses the feeling and desire of people in his own words, which may be own duly and regarded to second by the peoples them selves.
Approach to constructive motive lacks the verbal opinion of our politicians thus making them a free floater without a terminal beneficiary and if at all the end receivers are themselves.
We have developed lust to share and comments on every political or national issue with the pace and thrust as per our own opinion and calculations.
Horizon to perceive things at right place has been restricted to the desired goal and likings.
Without realizing the untoward effect and unforeseen upcoming threats , we awards the respective desire in the shape of positions without the element of qualification and in my opinion is the main culprit of all-time that presents as failure of policies.
This practice to detail persons unfamiliar with the subject as head of the subject position is the havoc that creates the gradual lapse and flaws to initiate and resolve critical decision in times of dire need as expert, thereby presenting with a hazard on national issues of credible importance and classifications.
If we look at the appointments and their office holder on national and provincial ministerial offices probably none of he individual qualifies as expert in the field on technical ground.
You see, it’s not the expertise of your tenure and services as politician but it’s your technical knowledge that takes you to a fruitful decision and long term benefit as nation.
We all are familiar with the eponym,” eyes do not see what mind does not know”.
My point of concern is why we can not allocate such important ministries that have impact on our day to day grievances and national requirement to a person that has a basic degree at least required in that specialty.
What’s the point of allocating ministry of health to a person unfamiliar with the medical terminology and ethical and basic requirements in the contest of health policies for the population?
Similarly award of religious ministry to a person who has infact never been to masjid or has never been in position to be taken as religious scholar.
In my opinion it is the same rift and deliberate stubbing attitude that has created and shaped off our society in to a down fall of disaster and this is because of the same inability to take and decide issues on lack of tech. knowledge that is the mother of all mischief.
It is the same fluttering point of abnormal rhythm.
It is the same point where one has to rely on the person that is familiar with the backup knowledge and is the core point that “takes the turmoil with the entry of establishment and those elements that has already planned incentives on behalves of the respective ministries, thus filling the preformed intention, move and opinion thereby sabotaging the credibility of the individual on front position, in the eyes of their people”.
This is the route that takes s the position and its occupant into wrong policies and their outcome.
Although the brunt to such attitude had been our fate as destined by these leaders, in the form of mandate but, I think concerning issues as attached to the sovereignty and integrity of the nation should not be compromised and such ministries like ministry of Defense, that has direct relation and demand critical decisions should be handled by experts already in the field and in service as uniform personnel.
By this I do not mean that a person in uniform should be the decision maker but he should act as an expert on technical grounds and such responsibility as head of ministry should be assigned to the head of the state, where as the minister heading the office should serve as the spokesman and member of the committee with full authority to implement.
Thus the decision making, be restricted at the authoritative and compulsory desire of the committee and their members, being as President, a military personnel minister of Defense and particular field qualified technocrats with a reputable and secure credibility.
Although this opinion may astonished many individual in the contest of democracy ,but in my opinion it is the democracy of Pakistan which is to be kept in mind and Pakistan army is the backbone that is required and mandatory for a nation like our.
Any grievances whatsoever, as leaders should not take a place, on national integrity and issues and reservations should kept aside when deciding the fate of the country in long term prospects and patriotic enthusiasm.
The theme of syllabus in a modified manner be implemented in ministry of interior as well as, the task assigned to this important ministry is equivocally a subject of mass expertise.
Headed by the minister, the ministry should report directly to the head of the state to issue further instruction and approval on behalf of the head of the state.
Decision making on any whatever issues should be made and in accordance to the head of the law enforcing agencies with serving civil and military personals and civilian experts in-law legislation and criminal psychology, and should gain the desire and advise in the form of committee.
All such committee members be awarded and honored the positions at the discretion of president and no nuisance what severs as to their appointment should curtail the direction of thinking.
It is worth noting here that institutionalizing of all such pillars are the essentiality and will serve as the process of restructuring so that the deprived nation can withhold what has been deliberately provoked by our self motive and centered ego and one man show order .
This will also serve as the check and balance that is a key factor to enroll as institution of credibility.
Similar trend in the name of reforms and continuous manipulation have again entered the premises of most important and prestigious pillar of public office, the judiciary.
Present anarchical placebo is the root cause of similar restlessness and displeasure.
Grant of reserve appointment at the discretion of the highest office again creates reservations and excuses by the office holders of similar positions in the form and format of representation against selections. In order to exercise the best, for the best, policy to designate and reimbursed new appointment should be reviewed and similar chain of experts opinion and qualification criteria is to be ensured to enter into the offices by those who are really the master piece of the art .
Being aware of system and design, I think the innate and necessary requirement of such selection requires enrollments on qualification for such seats on ground of conditional and unconditional prerequisite.
Although many such appointments from day one that ha been in my forum of think-tank is controversial but at present the matter of importance is to conceive for institutionalizing the pillar and decorum of the office by maintaining the credibility so to gain the maximize effect on long term portfolio.
Any thing that starts from the highest office and ends at the appointment of such positions, the factors of nuisance and over due grant can not be overwhelmed.
Pressure in the form and shape is always there as to pleased the final authority and this is the core point that disassemble the right from wrong.
In my opinion any such appointment that is crucified or likely to be crucified should get the opinion and advises of similar office holder as prim minister on mutual consent and equal weight age.
This will definitely shift the element of pressure in a balance mode.
The chain should receive the handful of justification of the community in the manner of recommendations in the form of feed back from the top most lawyers like ( late) Mr. k m Nadeem and Mr. fakhruddin g Ibrahim ,Aziz ullah sheikh(late) ,Mr. khalid ishaq ,Mr. Justice nasir aslam Zahid ,mr sajjad ali shah ,mr saeed uz zaman siddiqui etc, who were and are all time professionals and without political affiliations.
Although the name of experts that were previously known in their field as masters are now no more in this world but the point here is that they were in the field with no intentions as to their heavy practice to occupy the same .Search of similar name in the field are just a matter of initiative.
Similar feed back in the form of repot can be access from the ground realities from the leaders of the house of such bar jurisdictions by resolution and recommendations of the family of professionals.
Further processing as to the appointment should be conducted on account of reported cases with experience in the field.
Tenure of their services should be redesigned so to enable the new comers to adjust and classify the department.
Here I would like to endorse that all lawyers are not experts in all constitutional and other specialty like criminal, tax, family law etc.
Allocation of benches should be designed as to the requirement and in shape of respective specialty and seats be allocated according to the designated specialty.
This procedure alone can benefit the judiciary and can assemble different experts in one platform. This will also help to restrict and curtail extraordinary grant and patent desire to fulfill only those who are of the same school of thoughts as remuneration of their services.
The only, way in, would be, the requisite experience in particular field and endorsement of such field consultant by a passage of award of title trough their own immediate judicial benches.
This is a routine practice already in conductivity when on e qualifies as advocate of superior courts, who has to go through process of registration and interview .
In order to perceive and under stand this idea, we got to take discussion to the similar field of medical professionals.
Under the umbrella of this fields all appointment what so ever, are asked and enrolled as per basic qualification of that field.
A surgeon can not be placed on the appointment of radiologist and similarly a general surgeon can not occupy the seat of neurosurgeon or physician, although during emergencies all can handle the situation, but limitation is the part and parcel.
The same policy should also be applied to the field of judiciary.
All appointments whatsoever should be scrutinize and as per essential requirement and requisite criteria for qualification ,under the portfolio of specialty, in restricted class ,will itself serve the role to highlight and embark the most visible expert to get to the doors without objection and credibility .
In short in my opinion, this grant through one man show on feedback of their respective part partners of the state in the name of consultants as constitutional office holders of law offices, is the main factor that is causing troublesome maneuvering and credibility of such important assignment and urgent measure need to be initiated to and restructure the classical and traditional mode and method of appointment and feed back.
