The Islamic Concept of Leadership

Can we call ourselves Islamic? We declare our leaders as untouchables cause no capital punishment can be given to President or PM they say,
A- HAZRAT OMER BIN KHATTAB (RA) 13th Hijri to 24th Hijri:
Hazrat Mohammad Bin Muslima (RA) was the Chief Accountability Officer of Caliph Omer (RA), who was designated to conduct enquiries against the Officials/Governors of the then Islamic State. During 21 Hijri, Mohammad Bin Muslima was sent to Koofa (IRAQ) on some complaint received by Hazrat Omer (RA) against the then Governor Koofa i.e. Hazrat Saad Bin Waqas (RA) {one of the most pious amongst the Companions of Prophet Mohammad (PBUH) and his (PBUH) maternal uncle too}. Hazrat Muhammad Bin Muslima (RA) carried out the orders of Hazrat Omer (RA) and conducted the enquiries against the Governors and recorded the statements of complainants by calling them in the mosque of Koofa and after recording the statement Hazrat Muslima (RA) took Harzat Saad (RA) with him to present him before Hazrat Omer (RA) in Medina, where Hazrat Saad (RA) was again questioned by Hazrat Omer (RA). On several occasion Hazrat Omer (RA) instead of sending Hazrat Muhammad Bin Muslima (RA), used to call any Official/Governor to Medina directly on even minor complaints. Hazrat Ameer Muawiya (RA), Governor Syria was also called by Hazrat Omer (RA) in Medina on minor complain. Hazrat Abu Moosa Ashari (RA) Governor Basra (Iraq) was also called for such enquiries in Medina on minor complains and in Abu Moosa (RA)’s case Hazrat Omer (RA) had himself conducted the enquiries and recorded the statements of the complainants. {Asadul Aaba, Fil Ahwal us Sahaba, Treekh Ibn-e-Khaldun Chapter Prophet, Pious Caliphs and Calipahte of Muawiya wa Aal-e-Marwan, Voulme 1 and 2}.
Around 19 Hijri, Hazrat Omer (RA) received the complaint through internal spies (appointed for keeping an eye on Governors and Officials) against Hazrat Khalid Bin Waleed (RA) who was leading a Military expedition then and “Chief Commander of the Islamic Army”, that he (Khalid.RA) had his (RA) body massaged with an Oil which was mixed with liquor, that he (RA) had rewarded a poet Ashas Bin Qais around 10,000 Dirhams for offering some verses in the praise of Hazrat Khalid Bin Waleed (RA). Hazrat Omer (RA) after receiving the complaint ordered “that Hazrat Khalid Bin Waleed (RA) be arrested then and there (on Warfront) and he should be bound by his own Turban and be discharge from his rank and command imediately”. Hazrat Obaida (RA) carried out the order and called Hazrat Khalid Bin Waleed (RA) in an open gathering. The dialogue which ensued:
Hazrat Obaida (RA): How did you manage this amount?
Hazrat Khalid Bin Waleed (RA): Silence.
Hazrat Bilal (RA): Answer the question, how did?
Hazrat Khalid (RA): Out of my own pocket.
After these questioning he was released and sent Medina before Hazrat Omer (RA) for further questioning:
Hazrat Omer (RA): How did you get so much wealth to distribute it as a reward?
Hazrat Khalid (RA): Through Spoil of War.
Hazrat Omer (RA): If your share in Spoil is found to be unjustified and inequitable, then?
Hazrat Khalid (RA): I would deposit the unjustified amount in Baitul Maal (Bank).
After a check and further enquiries around 20,000 Dirhams were found exceeding and unjustified in Hazrat Khalid (RA)’s share which were later deposited by Hazrat Khalid (RA) in Baitul Maal. Another allegation was that Hazrat Khalid (RA) used to delay the Audit of Military Expenditure and Budget which was disliked by Hazrat Omer (RA). Subsequently Hazrat Khalid (RA) was dismissed from the position of the Commander and could never become Commander again but participated in Wars as only a soldier.

On another occasion during a Military Expedition two Generals namely Mugheera Bin Shaiba and Abu Bakara developed some dispute. There was already some animosity between Mugheera and Ziad Bin Abiya (relative of Abu Bakara), and the latest dispute added fuel to the fire. During a prayer, Mugheera was stopped by Abu Bakar from leading a prayer on the context that Mugheera was seen in an Objectionable Position by both Abu Bakara and Ziad so Mugheer cannot lead a prayer. Both of them also written a complaint against Mugheera and sent it to Hazrat Omer (RA) Medina. Hazrat Omer (RA) called both the parties in Medina and started proceeding in the case. During the proceedings the witnesses disputed their statement and Ziad Bin Abiya could not prove the statement against Mugheera which resulted in 30 Whips on Ziyad. The lashing was itself done by Hazrat Omer (RA). During the lashing Mugheera tried to intervene but he was severely reprimanded by Hazrat Omer (RA) who said to Mugheera, be silent, had this testimony been proper you would have also been punished.

B- HAZRAT USMAN BIN AFFAN (RA) 24 Hijri to 35 Hijri:
On the advice of Hazrat Omer (RA) , Mugheera Bin Shaiba was dismissed from his post on complaint.
Due to LOAN DEFAULT, Hazrat Saad Bin Waqas (RA), Governor Koofa was deposed by Hazrat Usman (RA). The Loan was taken as a credit from Baiul Maal.
Hazrat Abu Moosa Ashari (RA) Governor Basra was deposed by Hazrat Usman (RA) on the complaint that Abu Moosa used 40 Mules for his own use and common soldiers he advised footmarch for Jihad. (Please Pakistani Mullah and establishment take notes).
Waleed Bin Aqaba (Governor Koofa, earlier he was Governor Bani Taghlab and Jazeera) was called to Medina by Hazrat Usman (RA) on the complaint that he is a drunk. After thorough enquiry Hazrat Usman (RA) ordered to Saeed Bin Al Aas (RA) to whip Waleed 40 times, Hazrat Ali (RA) who was present there said take off his shirt and then whip him. Waleed was whipped 40 times then and there.
During Hazrat Usman (RA)’s last days of tenure, he himself addressed an open letter to the citizens of the then Islamic State (that includes the Non-Muslim Citizens as well) that ,” I have learnt that my Official/Governors are hurting common people therefor I have ordered that all the officials and governors would appear and gather during Hajj season and whosoever have any kind of complaint against any of my officials can come forward and after providing evidence can demand justice. {Tareekh Ibn-e-Khaldun Chapter Prophet, Pious Caliphs and Calipahte of Muawiya wa Aal-e-Marwan, Volume 1 and 2}.
C- HAZRAT ALI IBNE ABU TALIB (RA) 35 Hijri to 40 Hijri:
Hazrat Ali (RA) adopted the standards of the salary as were adopted by Hazrat Omer (RA) and Hazrat Abu Bakar (RA). Hazrat Ali (RA) used to be in tattered clothes during his (RA) whole tenure as a Caliph due to his poor financial state, and that was not the end in his entire tenure he wasnot able to build a single wall in his house due to his poor financial position. At the time of his martyrdom there were only 700 Dirhams in his deposits. Hazrat Ali (RA) never bought a single article from the market in his entire tenure as a Caliph from a shop or shopkeeper where he was known lest somebody grant him undue benefit in price of any article. Once Hazrat Aqeel {RA, the elder brother of Hazrat Ali (RA)} had asked some money to clear some debt through Hazrat Ali (RA) from Baitul Maal but Hazrat Ali (RA) blankly refused to do so and said to his elder brother that “do you want me to face hell by giving you money from the Baitul Maal without right”
{Ibn-e-Saad p 28, p 38, Ibn-e-Kaseer p 3, Ibn-e-Qutaiba Aimama Wal Siyasa p 71, Alasaba by Hafiz Ibn-e-Hajar p 487 Mutba Mustafa Mohammad Egypt}.
Hazrat Ali (RA) had said, I could not be elected secretly, I must be elected through the consent of Muslims. {Al-Tabari p 450}.
Hazrat Ali (RA) addressed a letter to one of his governor “donot keep distance with your subjects keep your people closer to you. This distance creates confusion and you donot know the real situation and small issues get bigger and big issues get smaller. The good things become bad for them and bad things become good for them. In the end the genuine Right get mixed up with the null and false.
Hazrat Ali (RA) used to survey in Koofa (Iraq) with a whip in his hand to check the day to day situation and in such a simple dress that one cant imagine and that too without any bodyguard.{Ibn-e-Kaseer p 4,5,8}.
At one occasion Hazrat Ali (RA)’s armour went lost but later on he (RA) saw that the same armour is being sold in Koofa’s market by a Christian. Hazrat Ali (RA) was a Caliph then and he didnt snatch that armour from that fellow, he (RA) approached the Chief Justice (QAZI) but failed to provide any evidence and subsequently Qazi gave the decision in the favour of that Christian and against the sitting Caliph i.e. Hazrat Ali (RA). As per Ibn-e-Khalqan, during a proceedings in a case between Hazrat Ali (RA) and a Non-Muslim when both appeared in the court . The Chief Justice greeted Hazrat Ali (RA) and stood and left his seat in the honour of Hazrat Ali (RA). Then and there Hazrat Ali (RA) reprimanded the Qazi by saying “that was the first INJUSTICE you did. {Behaqi- Al- Sunnan-Al-Kubra p 136, Waffiyat-ul-Ayyan p 168 Maktaba-al-Nahafta Al Misriay,Cairo Egypt}.
Hazrat Ali (RA) faced the worst kind of anarchy during his (RA) tenure due to Kharijites and tolerated their rowdy rather outright abuses cool mindedly. Once 5 Kharijites were presented before him and they were all abusing him and using derogatory terms against him and one of them was swearing upon God taht he would kill Harzat Ali (RA). Hazrat Ali (RA) released all of them on which the officials protested but Hazrat Ali {RA} only said if you want to answer them you can can abuse them as well but until they donot resort to open anarchy practically, I wont take any action, mere abusing and criticising me is not a crime. {Al Mabsoot-ul-Arakhsi p 145 Matbaul Saada, Egypt}.
D- UMER BIN ABDUL AZIZ (UMMAYYADS) 99 Hijri to 111 Hijri:
Although his tenure could not be called Pious Caliphate but his tenure was far better as compare to many Governments in Pakistan even the present one. He seized all the properties from Umayyads and surrendered the same into Baitul Maal as these properties were wrongfully acquired. On the orders of Caliph Waleed Bin Abdul Malik he whipped Khubaiab s/o Abdullah Bin Zubair (RA), 90 times which caused Khubaib’s death. Umer out of shame and remorse resigned from the post of the Governor of Medina. When Umer Bin Abdel Aziz became Ruler he surrendered all the properties which he wrongfully acquired and he even surrendered is wife’s jewelery in Baitul Maal and what remained with him was the property of 400 Deenar. He dismissed and deposed all the debauch, cutthroat governors installed by earlier rulers of Ummayyads. A decree was issued by him that nobody either Muslim or Non-Muslim would be whipped without law. No sentence of Amputation and Death would be issued without the prior approval of Umer Bin Abdul Aziz. {Al-Tabari p 314, 315- Ibn-al-Aseer p 158, 163}.
13- PREREQUISITE FOR RULERS AS PER HOLY QURAN, HADITHS, HOLY PROPHET MOHAMMAD (PBUH) AND ISLAMIC DOCTRINE:
Please tell, which of the qualities (even a single one) was/is in any of our nowadays so-called Islamic rulers of Past , Present and I am sure there would be none in our rulers of coming days. Which of these qualities are found in so-called Rulers of Pseudo Islamic Republics of Saudi Arabia, Iran and many others such Republics coming out of woodworks as Injustuices, Extra Judicial Killings, Camera Trials, Gang Rapes, Naked Parade of Women, Honour Killings, Biased Judiciaries, Dictatorships, Bonapartism, Monarchies in the name of Islam,Theocracy in the name of Islam are rampant and unabashed in Islamic Republics of nowadays.
a- The Holy Prophet Mohammad (PBUH) said: The people before went astray and were ruined because if a noble person committed theft, they used to leave him but if a weak person among them committed theft, they used to inflict the legal punishment on him. By Allah, if Fatima, the daughter of Mohammad, committed theft, I will cut off her hand. (Agreed upon Hadith).
b- The Holy Prophet Mohammad (PBUH) said: If Allah appointed anyone of you rules over a people and he died when he was still treacherous to his people, Allah would forbid his entry into Paradise. {Bukhari and Muslim}.
c- The Holy Prophet Mohammad (PBUH) said: He who doesnot look after his subjects with goodwill sincerity will be deprived of the fragrance of Paradise. {Ref}.
d- The Holy Prophet Mohammad (PBUH) said: A ruler who having control over the affairs of the Muslims, doesnot strive diligently for their betterment and does not serve them sincerely, will not enter Paradise with them. {Ref}.
e- The Holy Prophet Mohammad (PBUH) said: Allah, when one who is appointed as a ruler over my people troubles them, you should trouble him also and when he adopts a gentle attitude towards them, you should show mercy to him. {Muslim}.
f- The Holy Prophet Mohammad (PBUH) said: Fulfil the covenant of allegiance which is sworn first (then swear allegiance to the others). Conced to them their due rights and ask Allah for that which is due to you. Allah will call them to account in respect of the subjects whom He had entrusted them. {Bukhari and Muslim}.
g- The Holy Prophet Mohammad (PBUH) said: If Allah invites some one with administration over the Muslims and he shows negligence towards fulfilling their needs and objects and removal of property, He will act in a similar way on the Day of Judgement. {Abu Dawud and Tirmidhi}.
h- The Holy Prophet Mohammad (PBUH) said: The best of your rulers are those whom you love and who love you, who invoke Allah’s blessing upon you and you invoke His blessings upon them. The worst of your rulers are those whom you hate and who hate you and whom you curse and who curse you. It was asked (by those who were present): Should not we overthrow them with the help of sword. He said: No, as long as they establish prayer among you. {Muslim}.
i- The Holy Prophet Mohammad (PBUH) said: It is obligatory upon a Muslim that he should listen (to the ruler) and obey whether he likes it or not except when he is ordered to do a sinful thing, in such case there is no obligation to listen or to obey. {Agreed Upon Hadith}.
j- The Holy Prophet Mohammad (PBUH) said: Do not long for position of authority. If you are granted this position without asking for it you will be helped in discharging its responsibilities, but if you are given it as a result of your requesting for it, you will be left
alone as its captive. If you take an oath to do a thing and then find a better alternative, you should adopt the latter and expiate your oath. {Agreed Upon Hadith}.
k- The Holy Prophet Mohammad (PBUH) said to Abu Zarr (RA): Abu Zarr, I find you weak and I desire for you what I desire for myself. Do not rule over (even) two persons and do not manage an orphan’s property. {Muslim}.
l- Abu Zarr (RA) said to The Holy Prophet Mohammad (PBUH): Why do you not appoint me a collector? He (PBUH) patted me on the shoulder and with his hand and said: Abu Zarr, you are a weak man and it is a trust and it will be a cause of disgrace and repentance on the Day of Resurrection except for one who takes it up with a full sense of responsibility and fulfils what is entrusted to him (discharge its obligations efficiently). {Muslim}.
m- The Holy Prophet Mohammad (PBUH) said to Abu Huraira (RA): You will be greedy for getting a position of authority, but remember that it will be a cause of humiliation and repentance on the Day of Resurrection. {Bukhari}.
n- Hazrat Abu Musa Ashari (RA) said to The Holy Prophet Mohammad (PBUH): Messenger of Allah, appoint me governor of some land over which Allah gave you ruling authority. The other also requested for something to the same effect. The Messenger of Allah (PBUH) said: By Allah, do not appoint against this post anyone who seeks it and is greedy for it. {Agreed Upon Hadith}.
o- When Hazrat ABU ZAR (RA) requested the Holy Prophet (PBUH) for appointment to a public office, the Prophet Mohammad (PBUH)said, “public office is a trust, a source of lamentation and remorse on the Day of Judgement”.{Muslim}.
p- “To treat people equally in your presence in your company and in your decisions so that the weak despair not of justice and the strong have no hope of favour”. {Hazrat Omer (RA)’s advisory note to Koofa (Iraq)’s Governor}.
q- He must be competent, and be a man of integrity.
r- He shall treat his responsibilities as a sacred trust and discharge them with that spirit.
s- He shall abide by the principles of equality and equal opportunities vis-a-vis his people and their basic right.
t- He shall be accountable for all his Responsibilities and functions.
u- He shall encourage honest criticism and advice in regard to his role and functions.
w- He shall judge with justice.
x- We shall take care of the safety and security of his people and look after their welfare.
14- ELECTION OF A LEADER:
We celeberate the days of Pious Caliphs (RA) and hold seminars on them (RA) but do we follow them?
a- At the time of his death Hazrat Omer (RA) founded a body for electing a leader through counsel and further said, If anybody without the consent of Muslims tries to become ruler of the Muslim , kill him. Not only that he (RA) also banned his son (RA) from contesting for the post. {AL-TABARI page 292, IBN-ALASEER page 34, 35- IDARAT- UL- TABAT -AL- MUNIRIYA- EGYPT}.
a-Hazrat Ali (RA) had said, I could not be elected secretly, I must be elected through the consent of Muslims. {AL-TABARI p 450}.
b- At the time of Hazrat Ali (RA)’s death people came to him and asked can they elect Hazrat Hassan (RA) as the leader to which Hazrat Ali (RA) replied neither I stop you nor I forbade you, you can decide for yourself. At some point a person pointed out that why dont you (Hazrat Ali (RA)) elect anyone from your (RA) own sons (RA) as the leader on which Harzat Ali (RA) replied, I would leave Muslims in a same state in which they were left by the Holy Prophet Mohammad (PBUH). {AL-TABARI p112, AL-MASSODI -MUROOJ-UZ-ZAHAB p 42- ALMUTBA-UL-BAHIYYA EGYPT, IBN-E-KASEER, AL BIDAYA WALNAHAYIA p 13, 14 MUTBAUL SAADA EGYPT, AL-MASSODI p 46}.
15- FINANCIAL POWERS OF CALIPH ON ISLAMIC BANK OR BAITUL MAAL:
If this country is Islamic country then we must ask for audit of every account as our National Assets are already on line so there lefts no reason for not auditing these powers.
a- Caliph Hazrat Omer (RA) had once asked Hazrat Salman Farsi (RA) that am I (Omer) Caliph or a King? Hazrat Salman Farsi (RA) answered without fear that if you charge even a single Dirham from Muslim’s land wrongfully then you are a king not a caliph. Hazrat Omer (RA) had once said in a gathering that I swear upon God I dont understand that am I a King or Caliph, but if I have become a king then I am at loss. He (Omer) was told then and there by a person that Caliph do not accept anything without right and and do not spend without right whereas King robs Peter to pay Paul. {TABQAT-IBN-E-SAAD p 306, 307}.
b- The day when Hazrat Abu Bakar (RA) became Calip, he went out to sell some clothes because before becoming Caliph he used to sell clothes. When he was passing through the market he met with Hazrat Omer (RA), who asked why are you doing this? Hazrat Abu Bakar (RA) answered what else should I do I have to feed my family.
Hazrat Omer (RA) said you cant do it now as you are the Caliph and this status has greater responsibility, lets go to Hazrat Abu Obaidia (RA) the Administrator of Baitul Maal then. Hazrat Abu Obaida (RA) set the standard of the income of the Caliph as per the standard of the then common working man which was not equal to a wealthy person nor a poor person. Therefore the perks of the Caliph, 4000 Dirham per year were fixed by Hazrat Abu Obaida (RA). Near the death of Hazrat Abu Bakar (RA), he in his last will ordered that 8000 Dirhams must be returned to Baitul Maal from his (RA) belongings, on which Hazrat Omer (RA) said May God Bless Abu Bakar (RA), he had put every Caliph in a fix. {KUNZUL AMMAL p 2280, 2285}.
c- Hazrat Omer (RA) in a gathering said the right of any Caliph on Baitul Maal is One set cloth for the summer, one for winter and salary to support my family as per the standard of a middle class from Quraish. I am only a common man amongst the muslims. {IBN-E-KASEER AL BIDAYIA WALNAHAIYA p 134}.

15- CONCEPT OF GOVERNANCE:
There is lot of talk about Governance and for this we have several institutions in Pakistan but there is no Governance at all. Could we even try to adopt the following methods as per nowadays needs?
a- After being elected as a Caliph, Hazrat Abu Bakar (RA) in his first address said, “I have been chosen to become a ruler upon you though I am not the best amongst you, I swear upon God that I didnt accept this status on my will and wish neither I wanted that it should be given to me and not to any other nor I prayed for the same from God. I never had a wish in my heart to become a ruler. I accepted this office to save Ummah from anarchy.

I have no comfort in this status for me, the staus itself is a great burden upon my shoulders for which I have no power so help me God. I wanted that this status should have been given to somebody else, even now if you want to choose somebody else amongst the Companions of Holy Prophet Mohammad (PBUH) you are free to do so my will would not interfere in your will. If you would keep the same expectations from me as you used to keep with Holy Prophet Mohammad (PBUH) then dont because he (PBUH) was free from Satan and he (PBUH) used to receive prophecies from God. If I follow the right path then please help me and if not then straighten me out. Honesty and Purity are the Trust (Amanat) and Lies are Embezzlement. Those who are weak amongst you is strong for me until I would help him in delivering his right to him, God willing, and those who are powerful amongst you is weak before me until I snatch what’s not his right from him, God willing. It doesnt happen that when people quit striving in the way of God and God would not enforce subjugation on such people who leave the right path. God does not like those who follow the path of wickedness. Therefore follow me untill I follow the Lord and his prophet (PBUH) and if you see that I am not following both then dont not follow me. {AL-TABARI p 450, IBN-E-HISHAM AL-SEERAT ALNABWIYA p 311, KUNZUL AMMAL, No, 2261, 2264, 2268, 2278, 2291, 2299}.
b- Hazrat Omer (RA) after assuming charge said, “Nobody among the rightful has reached to threshold that he be followed …..people! You have rights upon me which I am telling you and you can demand an explanation from me. Your rights upon me are that I cannot demand anything which has been your God given right except allowed by the
law. {IMAM ABU YOUSUF KITABUL KHIRAJ p 117}.
c- When Hazrat Usman (RA) assumed charge he said, “listen! I am a follower not an initiator, so after Holy Quran, and way (Sunnah) of Holy Prophet Mohammad (PBUH), there are three more things which I promise with you that before my takeover of this charge, the Rules and Regulation which you have formed through Counsel and Consultation, will be followed by me. The matters on which there are no precedences would be decided through the Consultation. I will not take any action against you until the law allows it.{AL-TABARI p 446}.
d- Whenever Hazrat Omer (RA) used to send anybody as a Governor for any distant area, he (RA) used to advise them (RA) that I am not appointing you on the people to own their Hairs and Hides but for advising them for Salat (Namaz), providing Justice and distribution of Rights amongst them justly. {AL-TABARI p 273}.
d- Once during a Hajj gathering, Hazrat Omer (RA) called all the Governors to the centre and declared in a gathering that if anyone amongst the crowd had any complaint against them (RA) (Governors) then he/she can ask for redress. A person stood and complained about that Hazrat Umer Bin Al Aas (RA) that he (RA) without any cogent reason whipped me 100 times.
Hazrat Omer (RA) said comeon and take your revenge from Umer Bin Al Aas (RA) to which Hazrat Umer Bin Al Aas (RA) protested and said please dont open this door on Governors. Hazrat Omer (RA) answered I have seen Holy Prophet Mohammad (PBUH) taking revenge from his ownself (PBUH) by himself (PBUH). Then again Hazrat Omer (RA) ordered that particular person to take a whip and avenge. In the end Hazrat Umer Bin Al Aas (RA) saved himself by offering 2 Dirhams per Whip to that person. {IMAM ABU YOUSUF KITABUL KHIRAJ p 115, MASNAD ABU DAWOOD ALTIYASSI HADITH NO 55, IBNAL ASEER p 3, AL TABARI p 273, IMAM ABU YOUSUF KITABUL KHIRAJ p 116}.
f- Hazrat Ali (RA) addressed a letter to one of his governor “donot keep distance with your subjects keep your people closer to you. This distance creates confusion and you donot know the real situation and small issues get bigger and big issues get smaller. The good things become bad for them and bad things become good for them. In the end the genuine Right get mixed up with the null and false. Hazrat Ali (RA) used to survey in Koofa (Iraq) with a whip in his hand to check the day to day situation and in such a simple dress that one cant imagine and that too without any bodyguard. {IBN-E-KASEER p 4,5,8}.
16- RULE OF LAW:
When there is a Martial Law or Quasi Martial Law then there is no law and that is the history of this so-called Islamic Fort.
a- Once there was a dispute on some issue between Caliph Hazrat Omer (RA) and Ubbi Bin Kaab (RA) and both of them (RA) appointed Hazrat Zaid Bin Sabit (RA) as arbiter. When they both appeared before Hazrat Zaid (RA) , he stood in respect of Omer (RA) and offered him his seat but Hazrat Omer (RA) sat with Hazrat Ubbi (RA). When the proceedings started Hazrat Ubbi (RA) presented his case and Hazrat Omer (RA) rejected the claim of Hazrat Ubbi (RA). As per Rules and Regulations Hazrat Zaid (RA) should have made Hazrat Omer (RA) to take oath and swear which Hazrat Zaid (RA) didnt. Instead Hazrat Omer (RA) voluntarily took oath and at the end of that proceedings Hazrat Omer (RA) said Zaid (RA) doesnot deserve the post of Chief Justice (QAZI) until before him the ordinary Muslim and a Caliph i.e. Omer (RA) are equal. {BEHAQI AL SUNNAN AL KUBRA p 136}.
b- At one occasion Hazrat Ali (RA)’s armour went lost but later on he (RA) saw taht the same armour is being sold in Koofa’s market by a CHRISTIAN. Hazrat Ali (RA) was a Caliph then and he didnt snatch that armour from that fellow, he (RA) approached the Chief Justice (QAZI) but failed to provide any evidence and subsequently Qazi gave the decision in the favour of that Christian and against the sitting Caliph i.e. Hazrat Ali (RA).
As per Ibn-e-Khalqan, during a proceedings in a case between Hazrat Ali (RA) and a Non-Muslim when both appeared in the court . The Chief Justice greeted Hazrat Ali (RA) and stood and left his seat in the honour of Hazrat Ali (RA). Then and there Hazrat Ali (RA) reprimanded the Qazi by saying “that was the first INJUSTICE you did. {BEHAQI AL SUNNAN AL KUBRA p 136, WAFFIYAT UL AYYAN p 168 MAKTABA AL NAHAFTA AL MISRIYA, CAIRO EGYPT}.

You are talking about ideal state but all had started vanishing after the death of Hazrat Ali.Our 3 among 4 of khalifas were murdered and its had given way to wrong notion in communities living near to Muslims that Muslims believed on grabbing powers through channel of sword or by killing the people who were not in equation with each other.
The imposition of Islamic tribal medieval-ism and the ferocious Islamic Bedouins have proved to be too destructive, and crude barbarism won over a fine civilization .Societies under the Islamic rules went further down than any other in their total exclusion of women from political power and social influence. Islamic legislation went far beyond anything the Holy Prophet had originally dreamed of in his tribal religiosity in cheating women of their rightful place in society and in matters of marriages,inheritance,slavery and other rights.
There is no place for optimism for a liberal Islam. We have no doubts that nearly all Islamic states have failed to appreciate the basic human rights of their people, their women and their minorities. Saudis and Emirates the favorites states of west are the worst offenders; and are the financial godfathers of fundamentalism, extremism and Islamic backwardness everywhere..
Nearly every Islamic country under tyrannical rule which are all time supported by democratic western rulers is dangerous not only for itself but for the world as a whole.
Pakistan under US supervisions, for example, after supplying Iran and with Korea with nuke-secrets continues to offer the dangerous technology; Vietnam and Brazil are the new customers. The nuke-terrorist Dr. Abdul Qadir is safe, well protected and facilitated by the State of Pakistan, with full impunity.So under Dr qadir our Islam of Flag was raised by our Bedouin like leadership to harass others for accepting our supremacy as we did in middle ages of Islam .The over rule factor in this deficiency of real leadership had come by transferring control of oil and religious affairs in the hand of tyrannical Wahhabi culture and its western support.
Some personal beliefs have deadly consequences,the centrality of Islam to mental, social, intellectual and cultural backwardness; organized offenses against women and minorities; fundamentalism, extremism and modern terrorism are impossible to deny existing in our Islamic societies for centuries. “Religions of peace and tolerance” are mere empty words but see with whose joint venture it is all promoted.
Pakistan, Algeria, Saudi UAE .Afghanistan all have same thing common and it is its govt functionaries or military representatives are all time brokers of US dreams of controlling the world through her promotion of war culture under US flag.So this game is still going one and more accumulated as no leadership is coming from grass roots level.
