By Dr. Hassan Isfahani • Apr 20th, 2009 • Category: Pakistan Vote'08, Politics • 17 Comments

The Law and Justice Commission of Pakistan, in its meeting here, has discussed the proposal of “Post-Divorce Muta” for wives as ordained in the Holy Quran by revisiting the half-century-old Muslim Family Law Ordinance 1961 and the West Pakistan Family Courts Act 1964 keeping in view the changing needs of the society. The commission observed that the proposed amendment would be beneficial for a divorced wife and protect her from facing agonies after divorce, said a press release issued here on Sunday.

The meeting was attended by Attorney General Sardar Latif Khosa, Chief Justice Federal Shariat Court Justice Haziqul Khairi, Chief Justice Peshawar High Court Justice Tariq Parvez Khan, Chief Justice High Court of Balochistan Justice Amanullah Khan, Chief Justice High Court of Sindh Justice Anwar Zaheer Jamali, Chief Justice Lahore High Court Justice Khawaja Muhammad Sharif, Secretary Ministry of Law and Justice, Justice Agha Rafiq Ahmed Khan, Justice (Retd) Rana Bhagwandas, Justice (Retd) Amir-ul-Mulk Mengal, former Judge Lahore High Court Jawwad S. 1. Before discussing this Qoranic law as compulsion;ideal prerequisite is to go through Surah Nisa Ayat #23 ……………..

  2. If we consider the following jurists competent enough then let them look into it. Taking it up here is out of place & would unnecessarily create more confusion. Please, do a favor to your religion and coreligionists & lets just leave it to the following imminenet jurists .

The meeting was held here on April 18 under the chairmanship of :
Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry, who is also the chairman of the commission.

  3. Author here didnt clarify what the actual mutah law and its importance in our religion as it will confuse our non muslim readers. This law is linked with temporary marriage of women folk after becoming widow or divorcee for described time period .As per my information this law is only applicable in our shia community.
Th background of such law is that in pure Islamic society women should not be deprived of social security issues if her married life is hit by any kind of contingencies like death of husband and divorce.Such law was also significant in war areas where numbers of men were commonly reduced as compared to number of adult female.
Our most muslim sects never opt this law in their working conditions and secondly this law is very much fit in Arabs culture but some how our subcontinent culture could not absorb this Islamic law.

  4. The Mutah law is well adopted in west, and has the basic concept, requirements, obligation, responsibilities under protection of law exactly as described in Islam as ‘Common Law Wife” Common Law marriage”
I think it was a good and practical law, But what can we do sari naujawani gunnah aur haath say guzar di Muslim naujawan nasal nay.

  5. JUSTIN is Saeed khan

  6. Dr, RazaHaider is phuddoo

  7. @ Nazia
If you have any question about Mutah, as I have good knowledge, to discuss it with a bouquet of roses, or even a glass of water as witness, or simply propose to vacuum your house every weekend, or take you out for a candlelight dinner. I am the one you may discuss openly, and rightly. Hassan don’t have a clue what is he talking about.

  8. Justin or whoever?
thankyou very much for your generous offers but these would be waste of time for you people but no doubt if you have widow mother or divorcee sisters living under yours obligation then try to help them with with you knowledge regarding to this islamic law. This way you would prove be the true Islamic model that is applying his knowledge in his real life.
I dont need of bouquet as my gardener is doing this job, for cleaning purpose maid service is available to me and I can prefer to take my drink as per my requirement. For candle light dinner Allah has blessed me with the best man of world always with me in good moments of my life so try to follow my advice instead of abusing other under this important Islamic law.

  9. I am sorry but I cant digest it. It would open new venues—–for sin to be exact. Mutah was as pointed out by Nazia implemented in the war situations but that was only for that period. Secondly apart the honourable Judges some Islamic Scholars should also be consulted and I am not talking about the ones with some doctriate or PHD Imean the ones who have studied Shariah in its true essence.

  10. Nazia allinone

I am honestly, really pleased, impressed by your life style, and the luxuries, freedom you enjoy in your life. Mabadulat khush huay, and wish you the best in your life.
I also appreciate your bold beautiful and intelligent response. I could be disappointed anything less than this. Taka tak the khucha khuch.
My comment on Mutah, addressing you may sound little naughty, but no way a suggestion as I may dare not, so please don’t be intimated.
What made you so sure you have met The Best man already?
Best man will always give The best advice, and will never take a ——- from whoever

    Friendship Love and regards

  11. Understanding through Education, or Nazism

Education means realization which is sometimes a painful experience. For many, this would inevitably mean a process of changes. Any basically good educated society will survive these changes and be strengthened by them - not destroyed. Becoming more aware of yourself is the first step to understanding yourself. Understanding enables you to deal with yourself and others more effectively which means living a happier more fulfilled life.

My main point is, whatever you are feeling today, whatever truth you uphold or dogma you follow, there is always tomorrow, and there is only one thing that’s certain about tomorrow, it will be perceived different. Things change, your opinion or world view are always exposed to the constant influence of your surroundings. Also people growing up usually gain a better understanding of their surroundings and how things connect.

There will also always be some people who are stuck in the psycho-trauma which Nazism represents, but the fact is that most of the youth grow up and either change their views or start believing in other things. Just think about it, how many 40 year old are in the Nazi movement? Sure you have a few proclaimed profiteers and wannabe leaders, but the fact is that most people turn away from this religion of hate, with proper education, or meeting the right man.

  12. Dr. Hassan Isfahani could you kindly quote the Quranic verses which your are refering to about Mutah law?

  13. saeed
what is the background of this”deep rooted” philosophy under this topic.Under the lines to whom are your actually hitting and what is the theory of psycho trauma of nazism or nazi movement you created in your mind.Difficult to understand yours inaccurate concepts of understanding the people.

  14. Nazi
Hope you never understand this inaccurate concepts of understanding the people. The day you understood you will fell in love with it. It acts like a virus, the most modern and highly educated, well informed concept, you may never survive because of your poor environment, weak immune system you have inherited

  15. Saeed Khan, just by the way & chance, is there any relationship between what you mentioned above & Dr. Daniel Dennet? Please, answer. Am I mixing something here? I am kind of curious. Thanks.

  16. I am curious too that why saeed khan is looking so much worried about my poor environment and so called inherited weak immune system as there is nothing exists like that around me and in my lines that are being used as my identification here.and please who is this daniel bennette in this discussion. This ambiguity is still dominating here so cant be responded in proper way until point or charges should be put on clear way.
