Back in the Saddle

CHIEF Justice Iftikhar Muhammad Chaudhary showing his concern over the huge pendency of cases has directed the judiciary for their quick disposal, in which connection the High Courts are also conducting a meeting with the District and Sessions judges in the next week. It is said that justice delayed is justice denied, so the justice should be provided without any delay. In the first place, our problem is not the pendency of cases but just decision of the case. It is usual with the High Courts to issue directions time by time regarding particular cases for their early disposal, but myself a lawyer I have seen how parties have to suffer on account of such directions which mostly result in miscarriage of justice. It so happens that once a direction case comes before the court, the court naturally gives more attention to its decision rather than going into factual and legal aspects of the case, which obviously results in the miscarriage of justice. Secondly, if the judge is a corrupt one, interested party can get a decision in its favor easily by greasing the judge’s palms. What is most required at this stage is an eradication of the evil of corruption from judiciary.

In order to keep check and control over the corruption, the High Courts can establish a sort of committee comprising honest officials. This has been done in the past and it bore fruits too. Corrupt practice can also be abolished by a regular shuffling of pending files among the courts so that a particular file may not remain in just one court. Then the High Courts can increase the number of civil judges and judicial magistrates at District and Tehsil level in order to cope with the pendency of suits, and also the High Courts can establish new benches to decide the pending cases at the appellate stage. Whereas new benches would reduce the number of pending cases, they will be also helpful to the common lot who has to travel from remote areas to pursue their case at the appellate stage. With the Chief Justice back in the saddle, a lot of improvement is expected.

  1. Firstly as a person not fully informed in relation to the content of Pakistan law l can only speak as a man that has in the past dealt with the law of my land. This has been both directed at obtaining a conviction, without any thought as to the consequences caused to the victim, or whether he or she is guilty or innocent. But also relates to satisfying conviction rates to supply statistics to government bodies to collate sufficient information as to enable the public to believe what they are told.

    This suffice to say leads to many people being imprisoned on the basis of insufficient evidence and provides people with the feeling that they will be safe in their homes as all the criminals are behind bars.

And remember, your ‘chosen’ and elected representatives (shameless & without any conscience!) have already endorsed and legitimized them the Talibans& their agenda through their Sufi whatever who rejects all our institutions including our constitution which practically is negation of Pakistan !

    Too much is written about the CJP and nobody cares to point out the mistakes of the Army Chief who is indulging in politicking behind closed doors. Under his command the Pakistani army has ceased position and territory to the militants in NWFP, SWAT, FATA and BUNER. He is making deals with the elements who are bent on capturing not only those places but spreading to the whole of the country including Punjab!
    By the way they are only 60 miles from Islamabad and Maulana Fazlur Rehman the Aayaa Raam Gayaa Raam of Pkistani politics is fearful that between them and Islamabad there is only a dam which is acting as a barrier and once they cross this dam they will be in Islamabad.

  4. Let’s be clear about one fact and that is about our military & its capability. No military is strong enough unless it has totally resolved & a comitted nation behind it. I am just not willing to buy the balloony about our well trained & well equiped honest and devoted soldiers being defeated by a bunch of gangsters. It is not them who has failed, it is us the people who have failed to stand behind our government & our military, I am sorry to say that we, the people, have systematically humiliated and insulted, indeed, some of us have shamelessly ‘celebrated’ the wounds inflicted upon our brave soldiers. Anyone with any interest can research right here on TPS the kind of comments we have been collectively passing upon our own forces. All in the name of false notions of religion, democracy, free judiciary and, and, and! I have been consistently reminding right here that our ‘display’ of disapproval of the then government of President Syed Pervaiz Musharraf must not be directed at the security insitution we have raised and put together at great opportunity cost. Without failing I expressed my apprehensions right here that we are sending wrong signals to our enemies, but alas the so called educated and supposedly thinking Pakistanis refused take advantage of their education and decided not to think. I hope that we have learnt our lessons and I hope that it is still not late - we must remember anyone who is bent upon destrying us is our enemy and I don’t give a fuck if he claims to be somehow ‘related’ with us by virtue of a claim to our religion or ethnic affinity. The talibans are profaning Islam, they are defaming Islam and they are killing our citizens in the name of Islam. We must refuse this and we must disown them and we must push them whereever they have come from and if that results in their total destruction then WE HAVE TO DESTROY THEM and this is only possible when WE ARE UNITED AS A PAKISTANI NATION WITH OUR PATRIOTIC ZEAL.
