Ali Ahmad Kurd, Asma Jehangir Turn Against Iftikhar Chaudhry

By Maria Sultan • Dec 24th, 2009 • Category: Politics • 9 Comments

In a very interesting development, the volcanic leader of lawyers movement Ali Ahmad Kurd and the chairperson of Pakistan Human Rights Commission Asma Jehangir has spoken loud against the chief Justice of Pakistan Iftikhar Muhammad Chaudhry and his court.

These two people were among those who were the most prominent and all important figures to play decisive role throughout the campaign to restore the justice and they play a pivotal role in mobilizing the lawyers across Pakistan, and they kept the momentum going on for more than two years. Asma Jehangir represented a huge faction of civil society and she also garnered support from abroad, while Kurd’s hot speeches to lawyers are still remembered.

Both of them are apparantly angry and mad at the CJP for two slightly different reasons. Asma Jehangir is primarily ill at ease with the NRO verdict and its methodology. She is of the view that court hastened the whole process and the deliberations were not thorough and extensive. She says that judges should have exchanged the drafts of reasoning and then after profound analysis should have dished out their decision, which surely will have many far-fetching impacts on our country’s politica horizon.

Ali Ahmad Kurd is the typical lawyer who is feeling left in the cold in the aftermath of lawyers and justice movement. He is probably missing the limelight and the attention he got throughout the campaign. He is a naive person and has said it aloud. Like cagey Aitzaz Ahsan, he didn’t remain hooked to any political party to secure the future, and now he is feeling lonely. He is mad at the justices that why they are attending the bar functions in different cities and he feels that it should be him as former president of SCBA to attend the functions.

This situation is surely ideal for the PPP, when these two have distanced themselves from the CJP and Aitzaz Ahsan has joined the CEC of PPP. Now if judges are dismissed once again by the PPP, who will lead the new lawyers and judges movement?

  1. Chief Corrupt Judge will be lonely soon. As his release of detail judgement for 2007 dismissal of judges his finding is based on Bad Intention Of Musharaff?
What about the 3000 pages of allegation, misuse of authority, living and demanding more from bureucracy, and many more? Intentions were wrong but was there not truth to the charges? by then Dictator?

  2. Mafroozay ki bunyad buhat kamzor o paicheeda hoti hai…. behtar hota k apnay claims ko back karnay k liyay kuch na kuch citation lagai gai hoti…..

Opinions based on assumptions lack the stability….. its better if one back what he says by the proper citation instead of just saying for the sake of saying……..

  3. This is the difference between a fauji damagh and a civilian mind about seeing the level of difference of opinion.
It is normal practice in civilian set up that people cross fires each other and exchange views of differences to exercise their active healthy minds
Such forums are not like core commander conference where all sit quite and follow the orders of a US deputed officer .
It is not HQ of any unit where all should praised the BOSS and no other sound except Yes sir is heard only.
Asma and kurd are known for their long rendering services to legal system of Pakistan against all kind of tyrannical rules and should be placed on highest level of respect.
They are our respectable legal practitioners and their suggestions can be worth for whole panel of judiciary in view of their long term attachment with this system.
No body can challenge their authenticity in their fields.
But no way such conflicts can be considered as any movement against judiciary or any institution.
Asma jehnagir speaks vigorously against extra ordinary army privileges and its generals so we consider that she wants to fight with them??
As an aware and active professionals it is their right.
Now as usual criticism atmosphere is tryting to built against judiciary which process has been started in Musharf era.
No ruling mafia wants to see the uplift of strong judiciary in our system as then it will knock at the doors of all strongest oppressors of the system.
It is inner guilt of PPP management that is trying to provoke the masses by using different low level techniques like Sindh card, by threatening journalist or blaming on SC.
What SC did actually from the public point of view .
It nullifies a notorious acts which is not owing by even its creators.
Why SC couldnt pick President of Pakistan among 8000 criminals.
Among 8000 criminals mostly have run away but zardari and his team grabbed top seats of Pakistan through NRO only?
After grabbing this seat through short cut of NRO he followed same footsteps of corruption, placing the incompetent friends to important seats, and favoring wrong groups in corrupt deals.
So who will bell the wild cat?
Again this task has been given to CJP.
If people are taking it from different perceptions than it is diversity of human mind who can think for many options.
We all supported this free judiciary We were actually stood against the ambitions of a dictator so that no body will dictate personal choices and will on any institutions.
We should trust them and let them to perform in their way.
Our trust has been built on them for their outstanding courage and firm stand against corrupt management,
I think that they again fulfilled this demand of time that is to start from the top instead of selecting lower level of management.

  4. Hi nazia,
a very candid comment with lot of humour.
    Hi maria,
There were nearly 20 odd judges in this Supreme court but NOT one had a differing judgement. Now nobody wants to displease CJ of Pakistan. That is what Asma Jehangir has pointed out. She fought all those YES SIR types also.
Pakistan has to get out of SHEEP MENTALITY AND FIGHT THAT MENTALITY AMONGST POLITICIANS, PRESS, JUDICIARY while it is very difficult to change it in bureaucracy and ARMY.

  5. Pakistani people wake up, executives, and padliment is to blame for playing with NRO. Supreme court has just interpreted as unconstitutional. Now all corrupt powerful people are playing their fMous circus and we monkeys are playing in their hands.

  6. Johann
you are taking decision totally on different direction.
if we somehow follow your and asma point of view then it shows that Ch iftikahr is only tiger as we had Musharraf and whole country followed them twice with sheepish attitude to make boss happy.

NRO was passed in Musharraf regime although political parties made fuss that time but nobody could stop its implementation.
The actual fruit of NRO is corrupt team of zardari which was replaced by Musharraf regime. In this way front line was removed and all back door polices and technocrats as such stayed there to prevent US interests in the state matters.
SC without any distinction sent all ordinances of Musharraf which were not approved by house as per law.
This law stayed on assemblies desk for more than 3 months but all kept quite.
It was surprise to see that first mqm retrieved its support ,shaking the confidence of Zardari and CO who had no option left to run away from this stance.
You see not a single lawyer even barrister saif like admirer of Musharraf come forward to help and secure this ordnance to be converted as legal entity.
This was best moments for Musharraf team to prove their kinship with him but all vanished .
Even Musharraf the creator of this NRO is now declaring it as mistake.
Bhola badhsah dont know that when ruler do this kind of anti state mistake it is called crime against sate laws and it is punishable offense for rulers too.
So you see our all upper and lower houses, govt, law ministry, interior ministry, army, opposition no one come forward so why 17 judges tried to take the risk of its acknowledgment under the leadership of Ch iftikahr.
You can ponder in this way too…

  7. Asma Jehangir has one problem and that is anything that has even a hint of Islam enrages her. Supreme Court mentioned article 62 in it’s judgment which talks about honesty and integrity of a candidate and uses the word ameen. She thinks by revoking this article Supreme Court is setting a dangerous precedent and members of assembly may be required to be ameen and can be disqualified for not being morally binding. The funny aspect of all this is that no member assembly has ever been disqualified under this act. Even in Junejo government when one member assembly was accused of drinking alcohol the whole assembly stood by him.
Ahmed Kurd is angry on not being in the limelight like Aitezaz Ahsan and at least making appearances like Maria mentioned.

  8. “Ahmed Kurd is angry on not being in the limelight like Aitezaz Ahsan ”

yeah, 10 lac a case Itezez taking 3 crore now does make everyone a little envious. What was this 3 crore for, for the lawyer or for the judge?

  9. “limelight like Aitezaz Ahsan”

Every decoit shares his booty with Aitezaz in the name of “fee”.
